Products Liability

When you use a particular product, you assume that the manufacturer has engineered it to perform a particular task safely and effectively. You also assume that the actual construction of the product was done carefully so that it will perform as it was meant to. Some products, though, are unreasonably defective, either in their engineering or their manufacture, and cause serious injury even when being used correctly for the purpose for which they were made. In many products cases, when people are injured, they assume that no one was at fault. They do not realize that some companies actually knowingly put dangerous products into the stream of commerce. This is why you should always consult with an attorney after an injury that concerns any product. Defective products could be your automobile, the tires on your automobile, airbags, seatbelts, child car seats, lawn mower, chainsaw, hot water heater, stove, prescription drugs, cosmetics, tree stands for hunters, and many more.

Companies that allow dangerous items into the marketplace can be held accountable for resulting injuries. As your lawyer, it must be proven that the product was in fact defective or dangerous and that the product caused the injury. Some products if defective can cause serious personal injury or even catastrophic injuries. The foremost case in product liability law involved the Ford Pinto where it was known to Ford that the placement of the gas tanks exposed the occupants to an unreasonable risk of catastrophic injury or death. A simple change in the design of that car was known and could have prevented the deaths of the occupants of those cars.

Product liability law has since evolved to impose a level of responsibility on corporations for producing safe products on the market. Not only must the products be safe when used for their intended purposes, but there must be adequate warnings in order to prevent catastrophic injury or death to the user of the product. Something that may be obvious to the manufacturer of a product may not be so obvious to the ultimate user or consumer of that product
