What is a Personal Injury Attorney?
Personal injury attorneys represent individuals or groups of individuals who have been injured under the common law or statutory law. Primarily these involve torts or “tort law.” Personal Injury involves civil law cases where the goal is to be compensated for your injury whether for economic or non-economic damages.
Economic damages involves a person’s lost wages, i.e., out of pocket money for time away from work. Economic damages also involve out of pocket expenses for medical treatment for the personal injuries suffered. This can range from medical co-payments if a person has medical insurance, or prescription drug medication, counseling, medical supplies or devices like wheelchairs, crutches, braces, casts. In cases of more severe personal injuries, economic damages can involve life care medical plans, which set forth medical devices or life sustaining devices a person will need for the rest of his or her life. Personal Injury lawyers help you with any type of litigation involving physical injuries.
Non-economic damages involve damages that have no quantified amount of out of pocket loss. These damages can be psychological. For example, can you as an individual put a price on a lost leg or arm after a drunk driver slams into your car? Insurance companies most certainly do. My job is to ensure adequate and just compensation to the injured person for the mental anguish or pain associated with that lost leg or arm. I also ensure adequate and just compensation to our clients for any pain or trauma associated with an injury resulting in pain or disfigurement. I entrust these types of cases to our jury system, which is a right guaranteed by our state constitution and U.S. Constitution, as set for in the Bill of Rights.
The types of cases personal injury lawyers help you with arise from automobile accidents, railroad accidents, airline or other common carrier accidents, a construction or other workplace accidents, or product accidents, i.e., being injured as a result of a dangerous or otherwise unsafe product; otherwise known as “products liability.” However, personal injuries don't even necessarily have to be physical—they could be psychological.
A personal injury attorney must establish or prove that a defendant is legally responsible for injury. For example, a personal injury attorney must prove in a “Dram Shop” case that the bar owners knew that its patron was drunk, or in some instances that the person was predisposed to being drunk. If so, serving alcohol to that person, knowing that there is at least a chance the person will leave the bar in a car. When that happens, any number of innocent people can be hurt. Personal Injury Attorneys advise personal injury victims that if there is any failure on their part to exercise reasonable care to prevent injury or damage then there may be comparative (or contributory) negligence, where they and the other party both are at some degree of fault. If the personal injury victim wins, he/she may receive money (an award) to compensate for medical costs, lost wages and lost future earnings as well as possibly for pain and suffering and punitive damages.
